BY SCHEDULING/PAYING FOR/ATTENDING SERVICE CLIENT AGREES TO THE FOLLOWING:
1. Acknowledgment of Services and Risks
Client understands and acknowledges that:
- Services are provider by certified professional(s), but not necessarily licensed for specific services. The individual(s) providing services do not advertise or claim to be licensed in any particular field. All services provided are done as part of general performance coaching services and do not require state or otherwise required licenses. These services may utilize techniques including but not limited to fitness exercises, massage therapy, stretching, and yoga.
- Participation in exercise, fitness training, stretching, and injury prevention involves physical activity that carries potential risks of injury, including but not limited to muscle strains, sprains, soreness, bruising, abnormal blood pressure, fainting, or in rare cases, more serious conditions such as heart attack or stroke.
- The services are not a substitute for medical examination, diagnosis, or treatment. The coach does not diagnose medical conditions or prescribe medical care.
- It is the Client’s responsibility to inform the coach of all medical conditions, injuries, medications, or physical limitations prior to participation.
- The Client voluntarily chooses to participate, assuming all inherent and incidental risks.
2. Release of Liability
In consideration for receiving Services, the Client agrees to release, waive, and discharge the individual(s), their employees, contractors, and agents from any and all claims or liabilities for injuries, damages, or losses arising from participation, whether caused by negligence or otherwise, except for gross negligence or intentional misconduct.
3. Indemnification
The Client agrees to indemnify and hold harmless the coach from any claims, damages, or expenses (including reasonable attorney’s fees) that may result from the Client’s participation in the Services or failure to disclose relevant health information.
4. Medical Clearance
The Client affirms that they are physically capable of participating in performance coaching activities and have either:
- consulted with a physician and been cleared to participate, or
- chosen to participate without such medical advice, accepting full responsibility for that decision.
7. Photography and Media Release
Client consents to the use of photographs or videos taken during sessions for promotional purposes.
8. Cancellation and Refund Policy
Client agrees to comply with the Provider’s scheduling and cancellation policy:
- Minimum notice for cancellations: 12 hours
- Late cancellations or missed appointments may be charged in full.
9. Severability
If any part of this agreement is found invalid, the remaining portions shall continue in full effect.
10. Acknowledgment
Client acknowledges that they have read and fully understand this waiver and voluntarily agree to its terms.
